Terms of Service

1. Acceptance of terms

By creating an account or using OstaPal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to hosts (property owners and managers) who use OstaPal to manage their properties. If you are a guest booking through a host's property page, your booking is governed by the terms agreed upon with the host.

2. The Service

OstaPal provides tools to help short-term rental hosts create direct booking pages, manage reservations, set pricing, track finances, and communicate with guests. We are a software platform — we are not a party to any booking or rental agreement between you and your guests.

3. Account registration

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information and keep it up to date.
  • One person or entity may not maintain more than one account for fraudulent purposes.
  • You are responsible for all activity that occurs under your account.

4. Subscription and payment

OstaPal is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate.

  • Free trial — where offered, a free trial period does not require a credit card unless stated. After the trial, you will be charged unless you cancel.
  • Billing cycle — subscriptions renew monthly or annually depending on your plan.
  • Cancellation — you may cancel at any time. Access continues until the end of your current billing period. We do not provide pro-rated refunds for partial periods.
  • Price changes — we will give at least 30 days' notice before changing subscription prices.
  • Payments — all payments are processed by Stripe. We do not store payment card details.

5. Host responsibilities

As a host using OstaPal, you agree to:

  • Provide accurate and up-to-date property information, pricing, and availability.
  • Honor bookings made through your direct booking page.
  • Comply with all applicable local laws, regulations, and licensing requirements for short-term rentals in your jurisdiction.
  • Handle guest data (names, emails, booking details) in compliance with applicable privacy laws.
  • Not use OstaPal to engage in false advertising, discrimination, or any illegal activity.
  • Maintain appropriate property and liability insurance.

6. Acceptable use

You may not use OstaPal to:

  • Violate any law or regulation.
  • Infringe on the intellectual property rights of others.
  • Upload malicious code, viruses, or interfere with the Service's operation.
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts.
  • Scrape, copy, or redistribute the Service without permission.
  • Create fake listings or fraudulent bookings.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual property

OstaPal and its original content, features, and functionality are owned by OstaPal and are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

You retain ownership of all content you upload to OstaPal (property photos, descriptions, etc.). By uploading content, you grant OstaPal a non-exclusive license to host, display, and use that content solely to operate and improve the Service.

8. Third-party services

OstaPal integrates with third-party services including Stripe (payments), Resend (email), and Supabase (database). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

We may surface local content (things to do, restaurants, events) from third-party data sources. This information is provided for convenience and we do not guarantee its accuracy or completeness.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or free from security vulnerabilities. We are not responsible for any loss of data, revenue, or bookings resulting from downtime, bugs, or other technical issues.

OstaPal is not a party to any transaction between hosts and guests. We are not responsible for the quality, safety, or legality of any rental property listed on the platform, or for any disputes between hosts and guests.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSTAPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless OstaPal and its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your property listings, your guest relationships, or your violation of these terms.

12. Termination

You may cancel your account at any time from your account settings or by emailing hello@ostapal.com.

We may suspend or terminate your account immediately, without notice, if you violate these terms or engage in activity that harms the platform or other users. Upon termination, your right to use the Service ceases. You may request an export of your data within 30 days of termination.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

14. Changes to these terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
